Terms of Service

1. Agreement to Terms

By accessing or using warplink ("the Service"), operated at warpl.ink, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

warplink is a smart link management platform that provides short link creation, smart platform-based redirects, click analytics, A/B testing, custom domains, webhooks, and API access. The Service is provided on a subscription basis with a free tier and paid plans.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to use the Service
  • One person or entity may not maintain more than one free account
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to use the Service to:

  • Create links to malware, phishing pages, or fraudulent content
  • Distribute spam, unsolicited messages, or deceptive content
  • Violate any applicable law, regulation, or third-party rights
  • Infringe on intellectual property rights of others
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Artificially inflate click counts or manipulate analytics data
  • Resell, redistribute, or sublicense the Service without permission
  • Host or link to content that is illegal, harmful, or promotes violence

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Plans, Billing, and Payments

5.1 Free Plan

The free plan includes limited features as described on our pricing page. We reserve the right to modify free plan limits at any time.

5.2 Paid Plans

  • Paid subscriptions are billed monthly or annually in advance via Stripe
  • Prices are in USD and exclude applicable taxes
  • You authorize us to charge your payment method on a recurring basis

5.3 Cancellation

  • You may cancel your subscription at any time from your dashboard
  • Cancellation takes effect at the end of the current billing period
  • No prorated refunds are provided for partial billing periods
  • Upon cancellation, your account reverts to the free plan

5.4 Price Changes

We may change our prices with 30 days' notice. Price changes take effect at the start of the next billing cycle after the notice period.

6. API Usage

  • API access is subject to rate limits based on your plan
  • API keys are confidential and must not be shared publicly
  • We reserve the right to throttle or suspend API access for abuse
  • You are responsible for all actions performed using your API keys

7. Custom Domains

  • You must own or have authorization to use any custom domain you add to the Service
  • You are responsible for DNS configuration and domain renewal
  • We are not liable for issues arising from domain misconfiguration

8. Intellectual Property

The Service, including its design, code, and branding, is owned by warplink. You retain ownership of all content you create using the Service (links, analytics data, etc.). By using the Service, you grant us a limited license to process your content as necessary to provide the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.

10. Service Availability

  • We strive for high availability but do not guarantee 100% uptime
  • We may perform maintenance with reasonable advance notice when possible
  • We are not liable for downtime, data loss, or service interruptions beyond our reasonable control

11. Limitation of Liability

To the maximum extent permitted by law, warplink and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any bugs, viruses, or similar issues transmitted through the Service by third parties

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

  • We may terminate or suspend your account at any time for violation of these Terms
  • You may delete your account at any time from your dashboard settings
  • Upon termination, your data will be deleted in accordance with our Privacy Policy
  • Sections that by their nature should survive termination (liability, indemnification, dispute resolution) will survive

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through good faith negotiation first, and if unsuccessful, through binding arbitration.
